Please read these terms carefully before using the PropLead India platform. By accessing the Platform you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using PropLead India ("Platform"), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree with any part of these terms, please discontinue use of the Platform immediately. These terms apply to all visitors, buyers, sellers, and other users of the Platform.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts under Indian law to use PropLead India. By registering or using the Platform, you represent and warrant that you meet these requirements. We reserve the right to terminate accounts of users found to be under 18.

3. Platform Role & Disclaimer

PropLead India is an online real estate listing and lead-generation platform. We are NOT a real estate broker, agent, or developer. We do not buy, sell, or rent properties. All transactions are solely between buyers and sellers. PropLead India does not guarantee the accuracy, completeness, or legal status of any listing. Users must conduct their own independent due diligence before entering into any property transaction.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account (OTP-based login).
  • You must provide accurate and complete information during registration.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts for policy violations.

5. Buyer Responsibilities

Buyers using PropLead India acknowledge that:

  • Listings are posted by third-party sellers and PropLead India does not verify all details independently.
  • You must verify property title, approvals, RERA registration, and legal status before any purchase.
  • Placing a reservation is an expression of interest, not a binding purchase agreement.
  • PropLead India is not liable for any disputes, fraud, or losses arising from property transactions.
  • You will not misuse lead contact information obtained through the Platform.

6. Seller Responsibilities

Sellers listing on PropLead India must:

  • Ensure all listing details (price, size, location, amenities, RERA status) are accurate and current.
  • Only list properties they are legally authorised to sell or market.
  • Respond to buyer inquiries and reservations within 48 hours.
  • Comply with RERA and all applicable real estate regulations.
  • Not misrepresent government approvals, clearances, or legal status.

7. Prohibited Conduct

Users must not:

  • Post false, misleading, or fraudulent property listings.
  • Harvest, scrape, or collect personal data of other users without consent.
  • Attempt to bypass authentication, security, or access controls.
  • Use automated bots or scrapers without written permission from PropLead India.
  • Engage in any activity that disrupts, damages, or impairs Platform services.
  • Use the Platform to solicit users for services unrelated to property transactions.
  • Create multiple accounts to evade suspensions or bans.

8. Intellectual Property

All content on PropLead India — including logos, design, software, text, and data — is owned by or licensed to PropLead India Technologies Pvt. Ltd. You may not reproduce, redistribute, reverse-engineer, or create derivative works without prior written consent. Sellers retain ownership of listing content they upload, but grant PropLead India a non-exclusive licence to display and promote that content on the Platform.

9. Payment & Refunds

Subscription plans and pay-per-lead credits are billed in advance and are non-refundable once a billing cycle begins or credits are consumed. PropLead India reserves the right to modify pricing with 30 days' notice. Disputed charges must be raised within 15 days of the billing date by writing to legal@propleadindia.com.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PropLead India, its directors, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profit, data, or goodwill — arising from your use of or inability to use the Platform or any property transaction conducted through it. Our total liability in any matter shall not exceed the amount paid by you to PropLead India in the 3 months preceding the claim.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through mutual negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Jaipur, Rajasthan. The courts in Jaipur shall have exclusive jurisdiction for any matters not subject to arbitration.

12. Changes to Terms

We may revise these Terms at any time by posting the updated version on this page. We will notify registered users of material changes via SMS or email. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of those changes. We recommend reviewing this page periodically.
